Record numbers of migrants are securing thousands of pounds in legal aid to fight their deportation because it would breach their human rights to deny them the taxpayer-funded support.
Official figures show the number of immigration cases seeking emergency legal aid to challenge Home Office decisions has risen nearly tenfold in a decade from 234 in 2013-14 to more than 2,200 in 2024-25.
The migrants who are contesting Home Office attempts to deport them or deny them the opportunity to bring their families to the UK, are using the European Convention on Human Rights (ECHR) to sidestep rules that bar them from accessing legal aid.
The figures, uncovered by the Tories, have prompted fresh demands for the UK to quit the ECHR to allow ministers to block the payments.
